This Privacy Policy (“Policy”) explains how The Frisco News, FN, and its affiliated entities (collectively, “FN,” “we,” “us,” or “our”) gather and use your information when you access, buy, or subscribe to certain FN offerings. These offerings include our websites, newsletters, mobile versions, and downloadable mobile apps that contain an official link to this Policy (collectively, the “Services”). Additionally, this Policy outlines:

  • Which types of information FN collects about you via the Services;

  • How FN obtains this information;

  • How FN utilizes this information;

  • Who may access that information; and

  • FN’s methods for securing that information.

This Policy applies only to the data gathered through the Services. Please review it thoroughly.

By creating an account, registering, or logging in to the Services—or by simply visiting, viewing, subscribing to, or using the Services—you are consenting to and agreeing to the latest version of this Policy, as well as FN’s Terms of Service. Each time you continue to visit, view, subscribe to, or use the Services, you restate your acceptance of both this Policy and FN’s Terms of Service.

We urge you to read this Policy carefully so that you fully understand our privacy practices online. By using any of our Services, you affirm that your usage, along with any disputes related to our privacy practices, is governed by this Policy and by our Terms of Service (including limitations of liability, indemnification, arbitration, venue selection, class action waivers, and laws governing the agreement). Because technology evolves swiftly, we reserve the right to revise this Policy any time; we will post any such changes on this page. The “Last Updated” date will reflect the effective date of these revisions.

 

WHAT TYPES OF INFORMATION DO WE COLLECT?

In this document, the term “personal information” refers to any information (including personally identifiable details) that could enable someone to identify or contact you, whether physically or online (e.g., name, address, phone number, email address, Social Security Number). “Non-personal information” is anything else we might gather from you that is not personal information.

We collect both personal and non-personal information through our Services. Such information could include, but is not limited to:

  1. Identity Data: Your name, email address, username or similar identifier, birthdate, gender, marital status, title, or other basic demographic details.

  2. Contact Data: Your billing address, delivery address, email address, and telephone numbers.

  3. Financial Data: Payment card and bank account information you provide when purchasing something from us.

  4. Transaction Data: Information regarding payments to and from you, plus other details of Services you’ve bought from us.

  5. Device and Browser Data: Your IP address, internet service provider, login data, hashed email address, browser type and version, browser language, referring or exit pages, OS, date/time stamp, clickstream data, time zone settings, geolocation, location-based data from mobile devices, device type, unique device identifiers, browser plug-in details and versions, OS type, platform, plus other technical information you use to interact with our Services and digital properties.

  6. Usage Data: Details about how you engage with our Services (e.g., entry and exit points to the Services, how many clicks you make, how long you stay on a specific page or feature, which external websites or networks you visit from our Services). If you contact The Frisco News, we may also log details relating to how you reached us and how we interacted with you.

  7. Profile Data: Your username and password, purchase or order history, interests, preferences, feedback, and survey responses.

  8. Social Media Data: Comments, videos, photos, or images (and related information) that you post or publish through the Services, or that we access through your public or linked social media profiles (Facebook, Google Plus, Twitter, Instagram, etc.).

  9. Marketing and Communications Data: Your preferences about marketing communications from us or our third parties (if applicable), plus your communication preferences in general.

HOW IS INFORMATION COLLECTED?

We acquire personal and non-personal information whenever you interact with our Services: visiting, browsing, registering, subscribing, or using them in any way; enrolling in or buying any services or products in connection with them; or whenever you “sign in” or “log in” to the Services. We may also gather information when you allow the Services to access, upload, download, import, or otherwise interact with files on your device (or any device you use to access the Services) or online accounts with third-party sites, platforms, or apps (e.g., social media profiles, cloud drives, mobile providers). Additionally, we may request information in various contexts—such as when processing payments or when you participate in an online survey, sweepstakes, contest, or newsletter signup.

If you or a third party sends us any sort of message (by email, fax, phone, or similar methods) containing information about you or your activities on our Services, we may collect any personal or non-personal data that is included in or attached to that message.

We also employ multiple tracking and data analysis technologies, including:

  • Cookies: Small data files (often text) saved on your browser or device. They may track user preferences and actions to let a website recognize a particular browser or device. Varieties include browser cookies, session cookies, and persistent cookies. Cookies can record which pages you view for ease of navigation or transaction processing. Many browsers accept cookies by default, but you can generally adjust your browser or device settings to notify you before a cookie is stored or to block or remove some or all cookies.

  • Flash Cookies: These are cookies created with Adobe Flash and can be permanently stored on your device. Similar to regular cookies, they may store user preferences and activities, and allow websites to recognize devices or browsers. However, Flash cookies are managed through different settings than regular cookies.

  • Web Beacons: Bits of code (on a web page or email) that track certain user actions on that page or email. They can capture information like IP address, the particular URL on which the beacon is placed, the browser used, and existing cookies. They may also help with advertising metrics, such as page views or ad interactions. Turning off cookies or other tracking features on your device or browser may limit some web beacon functionality.

  • Scripts: Bits of code within a webpage that direct the site’s response to user activity (e.g., keyboard or mouse clicks). Scripts can be used to see how users interact with a webpage. They are typically downloaded briefly to your device from the website’s server and remain active only as long as you are connected. They may be disabled or deleted once you disconnect from the Services.

  • Analytics Tools and Services: We might partner with third parties to measure or generate data about site traffic, sales, and audience demographics for statistical, marketing, or content-rating purposes, as well as to track conversions. We may use third-party analytics like Google Analytics, and you may opt out of Google Analytics by following the instructions at https://tools.google.com/dlpage/gaoptout.

HOW DO WE USE YOUR INFORMATION?

We study the information you share with us to improve your overall experience with our Services. Your personal and non-personal data may be used and/or analyzed for the following purposes:

  • Conducting statistical analysis of Services usage;

  • Enhancing the range and quality of our content and product offerings;

  • Customizing the layout, features, and recommendations you see on our Services;

  • Addressing your questions or feedback;

  • Identifying and fixing technical or server issues;

  • Making location-based offers that may interest you, enabling you to post user-generated content linked to your location, and generally refining your experience;

WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

Our Affiliated Companies

We may share collected information with any entity that FN directly or indirectly owns, controls, or manages, as well as their staff members. This enables FN and its affiliates to inform you about offerings or services you might find valuable. Any additional disclosure or usage of information by those affiliates is subject to this Policy.

Vendors, Service Providers, and Provider Partners

Our business relies on a variety of external partners (e.g., payment processors, shipping and fulfillment companies, promotional partners, and similar) to help run and develop our Services. We may share with them any information we collect, as long as they commit to only use it in relation to the services they perform for us or our audience.

We may use or share non-personal, anonymized, or aggregated data with third parties (at our discretion) since it does not identify you as an individual.

Sometimes, a vendor or service provider collects data for us. Third-party providers displayed on or connected to our Services may also gather information on their own. In those cases, you should refer to their privacy practices.

We may occasionally collaborate with outside “Provider Partners” to offer features within our Services, such as car-buying services, personalized finance/weather resources, social networking features, or sweepstakes. We share personal information with these Provider Partners to the extent it facilitates these features. If any Provider Partner independently collects your personal information, their privacy policy and terms of service govern their usage and handling of that data. Other Disclosures

Regardless of anything that might seem contradictory elsewhere in this Policy or on our Services, we reserve the right to disclose personal information if doing so is necessary to:

  • Comply with the law or respond to an official request;

  • Enforce our Terms of Service;

  • Safeguard the rights, property, or well-being of our users, the public, FN, our affiliates, or any third party.

Additionally, if we reorganize or sell certain assets, lines of business, or if we merge with or are acquired by another entity, we reserve the right to share or transfer any information we have collected. This could take place in connection with an intended or concluded sale, merger, lease, liquidation, or other transfer of FN or our affiliates.

WHAT OTHER PARTIES MIGHT BE COLLECTING INFORMATION WHEN YOU USE OUR SERVICES?

Third-Party Advertising, Data, and Analytics Companies

We partner with various advertising networks and data providers, including Google, that help focus and deliver ads within our Services, send emails on our behalf, and supply analytics/forecasting tools. Many of these companies belong to the Network Advertising Initiative (NAI) and/or the Digital Advertising Alliance (DAA). Some ads on our Services may have cookies or web beacons controlled by outside advertisers or ad agencies we do not oversee. While using our website, we may share certain collected data—like your hashed email address, IP, or browser/OS details—with our partner LiveRamp Inc. Blogs, Discussion Forums, and Community or Social Areas

This Policy only applies to how we use and share data we collect. If you share your information in other ways or on different platforms—whether via interactive features, third-party services, or promotions accessible through our Services, or other websites across the internet—different guidelines will apply. Some of our Services include social networking functions, message boards, chats, or other interactive tools letting you communicate with others or post personal material (stories, photos, videos, etc.). If you disclose personal data in one of these spaces, it may be collected and used by others. FN is not responsible for how others distribute your disclosures in these forums. DATA RETENTION; AND HOW TO UPDATE OR DELETE YOUR PERSONAL INFORMATION

We will keep your personal and non-personal information only as long as it serves a valid business need. We reserve the right to dispose of or remove any or all of it at any time (including before any stated retention period elapses), unless a separate agreement with you or a legal requirement specifies otherwise.

For certain Services or features, you may need to set up an online profile and provide details like your name, address, city, state, and postal code (collectively, “Registration Information”). If possible, you may adjust or delete aspects of your profile or customize your subscriptions by logging into your account.

WHAT SAFEGUARDS DO WE HAVE IN PLACE TO PROTECT YOUR PERSONAL INFORMATION?

FN strives to use reasonable security measures to protect the integrity of the personal data you give us. However, no system can be guaranteed to be fully secure, and we cannot assure that our databases or transmissions won’t be compromised. You agree that we are not liable for any damage resulting from security breaches. By using our Services, you understand and accept that your data (personal or otherwise) may be transferred to, processed in, or stored in the United States and/or other places where we or our affiliates or service providers operate—even outside your local jurisdiction. Courts or other authorities in those places may have legal rights to access that data. We will take appropriate steps to verify your identity before letting you access or modify your profile to safeguard your privacy and security.

WHAT SHOULD YOU KNOW ABOUT THIRD-PARTY SITES AND ADVERTISING?

Our Services link to various external websites and provide pathways to products and services from outside providers whose privacy practices we do not control. Any interaction with external websites is AT YOUR OWN RISK. If you provide personal details to a third party site, it will be handled under that site’s privacy policy. YOU ARE RESPONSIBLE for reviewing and adhering to the policies of any third-party services you engage with. FN disclaims all liability for the content or privacy practices of any external website. Including a link in our Services does not equate to our endorsement of that site or its offerings.

MINORS

We do not intentionally request or retain—nor encourage the submission of—personal information from children under 16. If we discover that we’ve inadvertently collected personal information from someone under 16, we will make reasonable efforts to cease any further use of it or avoid storing it in a recoverable format. Additionally, we do not knowingly “sell” or “share” the personal data of those under 16.

If you’re under 18, you (or your parent/guardian) can request the removal of any posted content or information about you. Address such requests to Customer Care under the subject “Removal of Minor Information.” Please clearly specify:

  1. That this request is about the “Removal of Minor Information”;

  2. The particular Services relevant to your request;

  3. The exact content/information to remove;

  4. The URL or precise location of the content on the Services;

  5. Your name, mailing address, and email address;

  6. How you’d prefer us to contact you (mail or email).

We are not liable if we fail to comply with such a request due to insufficient labeling or incomplete information. Note that removing content does not guarantee full or comprehensive erasure from all parts of our Services. Also, we are not required to remove or eliminate content if (for example) another law obliges us to keep it, if a third party other than you posted it, or if it has been anonymized so you can no longer be identified.

This section is an explanation of our voluntary practices around the collection of minors’ personal data via our Services and is not intended to suggest that we are legally obligated by the Children’s Online Privacy Protection Act or similar international, federal, state, or local legislation.

If you’re a resident of California, you have the following privacy rights:

Right to Know / Access: You may ask for (i) the specific personal data we hold; (ii) the categories of personal data we’ve gathered; (iii) the categories of sources of that data; (iv) which categories of personal data we have sold or disclosed; (v) the categories of third parties who received that data; (vi) our reasons for gathering or selling that data. Generally:

    • We collect the categories detailed under “What Types of Information Do We Collect?” above.

    • We have disclosed: Identity Data; Contact Data; Financial Data; Transaction Data; Device and Browser Data; Usage Data; Profile Data; Social Media Data; Marketing and Communications Data as described earlier.

  2. Right to Deletion: You can request that we erase your personal data. We may refuse under certain circumstances (e.g., to honor legal obligations or complete a transaction). If we must deny your request, we will explain why.

  3. Right to Correct: You may ask us to fix any incorrect personal data we keep, subject to legal exceptions.

  4. Right to Opt Out of Sale of Personal Information: If we share your data with a third party (including through tracking technologies), you can opt out of the sale by using the “Do Not Sell My Personal Information” link on our homepage or contacting us at the email below.

  5. Right to Limit Use or Disclosure of Sensitive Personal Information: You can request restrictions on how we use or reveal sensitive personal data (as California defines it). We only use it if required to provide Services to you; if this changes, we will update this Policy.

  6. Right to Equal Service: We will not discriminate against you for exercising any of these rights. However, if you exercise some rights, certain parts of our Services might not function.

You can exercise your right to know/access or your right to deletion at no cost up to two times in a 12-month span.

Shine the Light: As described in this Policy, we may share your data for marketing. Under California law, residents may request once per year, free of charge, a summary of personal information we have provided to third parties for direct marketing, including the categories of information shared and the identities/addresses of those parties. YOUR NEVADA PRIVACY RIGHTS

INTERNATIONAL LAW

We oversee, host, and manage the Services within the United States. We make no claim that anything on our Services is lawful or accessible outside the U.S. Access from regions where the Services or content is deemed illegal is prohibited, and you may not use or export the Services if you violate U.S. export regulations. Should you access the Services from outside the U.S., you assume the obligation to comply with all relevant local laws. We do not presently extend our Services to EU citizens or residents.

All our correspondence to you will be sent electronically. You agree that these messages satisfy any requirement that they be “in writing.”
